New Jersey’s Authority On Real Estate And Property Tax Matters

The Process For Appealing Your New Jersey Property Tax Assessment

Once we have determined a property tax appeal is warranted in your case, the appeal must be filed with the County Board of Taxation or the Tax Court of New Jersey, depending on your property’s assessed value. In most cases the appeal deadline statewide is April 1, although your filing deadline may be extended to May 1 if your municipality has implemented a revaluation or reassessment in the prior tax year. Please note that appeals in Monmouth County and Gloucester County for properties assessed at $1 million and under must be filed by January 15. However, appeal deadlines can vary considerably based on many factors — our firm can help you determine when your appeal is due.

Savvy, Skilled, Experienced Tax Attorneys Are Here To Help

At Heinze Law, P.A., we attempt to settle the matter with the assessor and municipal attorney. Settlement can occur outside of the court process or in court if required by the judge. With over 30 years of experience, our team is fully capable of handling all aspects of your tax appeal efficiently and completely, including meeting deadlines for filing your appeal, submitting evidence of market value to the tax assessor, negotiating settlement with the municipality, securing a trusted expert appraiser, challenging the assessor’s evidence, negotiating future tax assessments and other issues that require our attention and skill.

Our attorneys litigate cases for residential, commercial and industrial clients throughout New Jersey. Every case is unique, and the valuation process of every type of property varies significantly, requiring far more than a cursory knowledge of the appeals process to secure a favorable outcome for your maximum savings.

Help For Both Commercial And Residential Property Tax Assessments

Most appeals of commercial property tax assessments (except for businesses formed as Limited Liability Companies or LLCs) and nearly all residential property tax assessment appeals do not require the involvement of an attorney, but having professional legal counsel is highly beneficial. Our attorneys are thoroughly versed in the appeals process for various types of property, know which courts your appeal could be heard in, and understand how to challenge the assessment amount and obtain the best result for your individual situation, whether you own a single-family home or a multi-tenanted large commercial property.

We can provide representation if the assessor requests a site inspection to examine property-specific circumstances, such as flooding issues, limited property development opportunity, depreciation, deterioration, miscalculation of square footage by the assessor’s office, etc. If your case cannot be resolved in a settlement conference, we will represent you at trial if that proves necessary.

How Long Is The Property Tax Appeal Process?

Cases filed before the County Board of Taxation are typically heard a few months after the initial filling. Judgments are received shortly after County Board of Taxation hearing dates in most cases. However, resolution of cases at the Tax Court of New Jersey may take longer – sometimes over a year – depending on a number of factors including the complexity of the case and the current caseload of the court.
